The attorneys will provide a historical backdrop from past real estate downturns, including a discussion of bankruptcy law principles, that provide the framework for current market documentation and best practices for lenders. ’s attorneys will also highlight the importance of “bad-boy” guarantees and special purpose entity and bankruptcy remote covenants in real estate lending structures. Finally, our presenters will discuss issues concerning defaults and lender liability that touch troubled real estate loans.
